In the first case of its kind, the tribunal
administratif of Paris has overruled a
housing mediation commission and upheld
an applicant’s right to housing. The
commission had ruled that the application
of a mother of two was not “urgent”. Single
mother Namizata Fofana (aged 26) had
made a number of applications for housing,
all of which had been turned down. The
new law making housing a right
enforceable in the courts does not come into
play until December 8 of this year. Despite
this fact, the court decided that the case was
urgent and enforced her right to housing
because she was living in a reception centre
for social reinsertion which she and the
children would have to leave on June 9. The
housing authority was given a month to deal
with the matter.

Due to medical errors and negligence, 111
young people died after taking growth
hormones extracted from dead bodies. After
16 years of investigation and a trial lasting 15
weeks, the seven doctors and others charged
with responsibility have taken the opportunity
of the trial to say they were sorry for what
happened.
Particularly in the firing line has been
Professor Job, president of the Association
France Hypophyse, and the bio-chemist
Fernand Dray of Laboratoire Uria of the
Institut Pasteur, responsible for processing the
brain cells taken from bodies in morgues.

Two reports have been published by Société
Générale about the Kerviel affair which
cost the bank €4.9 billion. One is by three
directors of the bank and the other by Price
Waterhouse Coopers.
Price Waterhouse Coopers (PWC) is
careful to point out the limited nature of its
report. “We have not carried out an
investigation of the fraud. In reality, this task
was carried out by the Inspection Générale
[the bank’s internal auditors],” it stipulates. It
is essentially an auditors’ report on the evident
systems failures and how to put them right.

The government is radically
reforming the constitution of the
Fifth Republic. The changes will limit
to two the number of terms a
president can serve. It will increase
the power of the Assemblée nationale
to monitor government policy,
particularly on defence and the
appointment of top officials.
All this is currently solely within
the power of the president, who
makes 60,000 appointments a year.
The reform will also allow the
president to address a joint session of
the Sénat and the Assemblée
nationale once a year. Nicolas
Sarkozy finds it absurd that as
president he cannot come before
parliament to present his plans
himself. Critics say this would
undermine the power of the prime
minister in running the government.
Sarkozy argues that, whatever the
constitution, no one has ever doubted
that the president runs the show.
